The Customers & Suppliers module includes three overdue and uncontested outstanding payments per insurance year. You send the first reminder yourself, and after that we will help you enforce the claim. Our Debt Collection PLUS supplementary insurance gives you the option of expanding your debt collection coverage to include an unlimited number of overdue and undisputed debts.

Which debt collection cases are not insured?

What does “overdue and undisputed debts” mean?

A debt is overdue if the agreed payment date has passed. It is considered to be undisputed if the opposing party does not dispute the fact that payment is owed – i.e. they are not objecting to the debt (e.g. amount, reason or contract). Collection of such outstanding and undisputed debts, whose validity is recognized by the opposing party and whose payment deadline has passed, is insured. 

Which requirements must be met for the debt collection procedure?

In Switzerland, a distinction is made between out-of-court collection (e.g. reminders) and state debt collection under the Federal Act on Debt Enforcement and Bankruptcy. If you wish to effectively enforce unpaid debts, they must be real and overdue and you must be able to prove this through a contract, invoice, order, etc. You must submit the debt collection request to the debt enforcement agency at your place of residence or the domicile of the debtor party and pay the fee in advance. Although sending a reminder letter prior to this is not required by law, it is a recommended practice. If the debtor party files a legal objection within ten days, you must prove the existence of the debt in court.
